Recruitment of Filipino Workers

Overseas employment is a highly regulated industry in the Philippines. Only entities and individuals duly licensed and authorized by the Philippine Overseas Employment Administration (POEA) are allowed to recruit and deploy workers for overseas sites.

Designed to enhance protection of Overseas Filipino Workers (OFW's), strict laws and rules are put in place. The POEA acts as the super body that administers and regulates the entire recruitment and deployment process.

Accredidation Process:

Prior to any recruitment activity, foreign employers and their agents have to undergo an accreditation process with the POEA, with the participation of the Philippine Labor Attache in the country of assignment. In this regard, the following documents are required:

  1. Special Power of Attorney (SPA) issued by the foreign employer to its recruitment agent, assigning the latter as its legal representative in the recruitment process;
  2. Employment Contract to be used for the workers to be engaged. The use of your company's employment contract is also allowed;
  3. Manpower Demand of the foreign employer indicating the categories needed, number required, corresponding basic salaries and contractual benefits;
  4. Recruitment Agreement by and between the foreign employer and its recruitment agents, establishing therein the obligations and terms of their recruitment relationships;
  5. Company's commercial registration or valid business license of the foreign employer in the host country to establish its legal presence thereat.

The above documents must be verified by the Philippine Labor Attache in the host country. Thereafter, the verified original documents shall be sent to us in Manila via courier for the accreditation process with the POEA.

Recruitment and deployment can legally take place only after compliance of the entire accreditation process. For subsequent manpower requirements however, emailed manpower demands shall suffice, where POLO verification will no longer be required.
